CMPak, which is operating in Pakistan with the name of Zong has recently been seen very dissatisfied with the spectrum being sold at 1800 Mhz. This is the same frequency for DECT 6.0 devices, which has given much noise and interruption in the data transmission.
Zong sent a Legal Notice through Counsel saying that PTA intentionally put on auction a defective frequency already under use and is still creating interruptions and hindrances in 3G frequency. The interference are even before the Auction.
Recalling the incident, Zong had gone for spectrum auction in 2014 and had won the frequency spectrum band of 1920-1930 and 2110-2120MHz for 3G network. In addition to this, DECT 6.0 devices, which are currently being operated from abroad, operate in the same 1920-1930MHz , create distortion in Zong’s spectrum.
It is important to note that both PTA and FBA did allow to auction these frequencies for next-generation knowing that they will disturb the spectrum. The copy of Legal Notice says that it is the breach of warranties given with the spectrum purchase.
Legal Notice demands PTA to respond to the notice within 15 days for following demands:
- Zong should be allocated 5MHz of a substitute band in 1950-1955MHz and 2140-2145MHz band and remaining price of 5MHz that Zong has already paid — along with KIBOR plus 3 percent — should be refunded.
- If money isn’t refunded then an equivalent amount of money must be rebated against various fee and dues that Zong will have to pay to PTA in future.
- Zong be given a compensation of US 40 million dollars for:
- Loss of revenues during last 12 months
- loss of market share
- Incremental costs incurred during this time in network optimization, cost of additional resources deployed to identify, evaluate and combat interference.
Copy of the legal notice was also circulated through Prime Minister Office, FAB, Chinese Embassy, MoIT, Cabinet Division and Finance Division. Failing to respond to the notice will be end in further action against PTA. A recent update has unveiled that the two sources are already in discussion and has reached a solution.
