It seems that Samsung has not fully settled upon it recent payment to Apple after failing the patent war in the court. The South Korean tech giant has yet again filed a petition in US court against the decisions of high court for patent fight. The company is asking for re-examination of the case.Samsung while doing this made the following statement:
“While Samsung prefers to compete in the marketplace, not the courtroom, the company feels that it is important to appeal this case to the US Supreme Court on behalf of all US companies, big and small, that could be affected if this legal precedent stands,”
The company has currently appealed that in cases of utility patents, it is not much difficult to make the jury understands how this patent works for companies as compared to design patents. So there is a lot of margin lies in misinterpreting patents regulations over the industry.
Samsung also argued the method upon which these patents damages are estimated. He said scenarios certain companies who convicted are obliged to pay the amount multiple the times of profits.
“Samsung is escalating this case because it believes that the way the laws were interpreted is not in line with modern times,” it further added to its statement. “If the current legal precedent stands, it could diminish innovation, stifle competition, pave the way for design patent troll litigation and negatively impact the economy and consumers.”
Meanwhile, it is worth noting that other companies like eBay, Google, and Facebook are also supporting such petition is US courts. The Supreme Court has yet not taken any decision whether to overrule this petition or consider it as it has not taken any design patent case since 1800s.
